Regulations on the Work of Family Planning Among the Migrant Population (Adopted at the 60th Executive Meeting of the State Council on April 29, 2009, promulgated by Decree No. 555 of the State Council of the People’s Republic of China on May 11, 2009, and effective as of October 1, 2009)

Article 1 These Regulations are formulated in accordance with the Population and Family Planning Law of the People’s Republic of China, for the purpose of strengthening the work of family planning among the migrant population through embedding management in the provision of services, safeguarding the lawful rights and interests of the migrant population and maintaining the low fertility level.

Article 2 The term “migrant population” in these Regulations means the adults of childbearing age who have left the counties, cities or municipal districts where their residence is registered and are working or living in other places. However, the following persons are not included:

(1) those who are staying in other places on business trips, for medical treatment, education, tours, on family leave or for visiting friends and are expected to return to live in the places where their residence is registered; and

(2) those who are staying in other districts than the districts of their registered residence within the same administrative area of a municipality directly under the Central Government or a city divided into districts.

Article 3 The local people’s governments at or above the county level shall exercise leadership over the work of family planning among the migrant population within their respective administrative areas, incorporate the work of family planning among the migrant population into their local economic and social development plans, and ensure that necessary conditions are provided; they shall establish a sound mechanism for coordinating the work of family planning among the migrant population, and organize the coordination among the relevant departments in exercising comprehensive management of the work of family planning among the migrant population; and they shall implement the responsibility system for management by objectives under which the work of family planning among the migrant population undertaken by the relevant departments can be evaluated and supervised.

Article 4 The work of family planning among the migrant population shall be the shared responsibility of the people’s governments of the places where the residence of migrants is registered and where the migrants are currently staying, and the latter shall play a focal role, with the former providing cooperation.
