Article 5 The population and family planning department of the State Council shall be in charge of the work of family planning among the migrant population nationwide, formulate plans for the work of family planning among the migrant population and organize the implementation thereof; it shall establish the information management system for family planning among the migrant population, so as to achieve the sharing of family planning information between both the places where the residence of migrants is registered and the places where they are currently staying, and the sharing of population information among the information management systems of the relevant departments.
The population and family planning departments of the local people’s governments at or above the county level shall be in charge of the work of family planning among the migrant population within their respective administrative areas, implement the measures of management and services in respect of family planning among the migrant population set by the people’s governments at the corresponding level, organize the inspection and evaluation of the work of family planning among the migrant population, establish a reporting system of information about family planning among the migrant population to collect and report information in this respect, accept and promptly handle reports against offences in respect of the work of family planning among the migrant population, and protect the relevant rights and interests of the migrant population.
The departments of the people’s governments at or above the county level for public security, civil affairs, human resources and social security, housing and urban-rural development, health, pricing, etc. and the administrative departments for industry and commerce at or above the county level shall, within their respective functions and duties, be responsible for the relevant work of family planning among the migrant population.
Article 6 The township or town people’s governments and the sub-district offices shall be responsible for the work of family planning among the migrant population within their jurisdiction, conduct family planning management among the migrant population and carry out publicity and education on family planning; they shall arrange for the institutions that provide family planning technical services to guide the couples of childbearing age among the migrant population (hereinafter referred to as the couples of childbearing age) in choosing safe, effective and appropriate contraceptive methods, and provide gratis, in accordance with law, the couples of childbearing age with the basic items of family planning technical services specified by the State.
The township or town people’s governments and the sub-district offices of the places where the migrants are currently staying and where the residence of the migrants is registered shall establish a reporting system among them for exchanging information about family planning among the migrant population, promptly collect information about family planning among the migrant population, and verify and report to each other such information through the information management system for family planning among the migrant population.
