Regulations of the People’s Republic of China on Traditional Chinese Medicine

Article 7 The people’s government at or above the county level shall reward the institutions and individuals that make great contributions to inheritance and development of the traditional Chinese medicine undertaking, or that engage in the work of traditional Chinese medicine in remote areas and make outstanding achievements.

Chapter II Institutions and Practitioners of Traditional Chinese Medicine

Article 8 An institution of traditional Chinese medicine to be established shall not practice traditional Chinese medicine until it has met the standard for establishment of the institutions of traditional Chinese medicine formulated by the health administrative department of the State Council and the regional health plan of its locality, undertaken the examination and approval formalities according to the provisions of the Regulations on Administration of Medical Institutions, and obtained the license for the medical institution.

Article 9 When engaging in medical service, an institution of traditional Chinese medicine shall fully exploit the characteristics and advantages of traditional Chinese medicine, follow the course of the development of traditional Chinese medicine, combine traditional theories and practice with modern scientific and technological means, bring into play the role of traditional Chinese medicine in disease prevention, health care and rehabilitation, and provide reasonably-priced high quality traditional Chinese medicine service to the people.

Article 10 Urban and rural health service institutions legally established at the grass-roots level, such as community health service centers (stations) and town and township hospitals, shall be able to provide medical service with traditional Chinese medicine.

Article 11 A practitioner of traditional Chinese medicine shall not engage in traditional Chinese medicine service until he has passed the qualification examination in accordance with the laws, administrative regulations and department rules on health administration and obtained a license through registration. A person who has studied traditional Chinese medicine in the way of apprenticeship or a person who has proved to have special expertise in this field shall not practice traditional Chinese medicine until he has passed the appraisal and examination for the qualification of a licensed doctor or licensed assistant doctor in accordance with the provisions of the health administrative department of the State Council and obtained a doctor’s license through registration.
