Regulations of the People’s Republic of China on Traditional Chinese Medicine

Article 12 A practitioner of traditional Chinese medicine shall observe the relevant principles of diagnosis and treatment, standards of medical technique and rules on technical operation for traditional Chinese medicine. A general practitioner or a village doctor shall have the basic knowledge of traditional Chinese medicine and the basic skills for dealing with common diseases and frequently occurring diseases with the knowledge and techniques of traditional Chinese medicine in diagnosis and treatment.

Article 13 A medical institution that is to publish a therapeutic advertisement of traditional Chinese medicine shall, in accordance with the provisions, make an application and submit the relevant documents to the department responsible for administration of traditional Chinese medicine of the people’s government of the province, autonomous region or municipality directly under the Central Government where the institution is located. The department responsible for administration of traditional Chinese medicine of the people’s government of the province, autonomous region or municipality directly under the Central Government shall, within ten workdays from the date of receiving the relevant documents, examine these documents and make a decision on whether to grant an approval number of therapeutic advertisement of traditional Chinese medicine. For an advertisement conforming to the relevant provisions, an approval number shall be granted. The medical institution that is not granted such an approval number shall not publish therapeutic advertisement of traditional Chinese medicine. The content of a therapeutic advertisement of traditional Chinese medicine published shall be in consistency with that of the approved one.

Chapter III Education and Scientific Research of Traditional Chinese Medicine

Article 14 The State takes measures to develop education of traditional Chinese medicine. Traditional Chinese medicine educational institutions of various categories shall strengthen teaching of basic theories of traditional Chinese medicine, place emphasis on integration of the basic theories and clinical practice of traditional Chinese medicine and enhance the quality-oriented education.

Article 15 Traditional Chinese medicine educational institutions of various categories to be established shall meet the standards for establishment formulated by the State and have clinical teaching bases in compliance with the standards formulated by the State. The standards for establishment of traditional Chinese medicine educational institutions shall be formulated by the health administrative department of the State Council jointly with the education administrative department of the State Council; the standards for clinical teaching bases of traditional Chinese medicine educational institutions shall be formulated by the health administrative department of the State Council.
