Regulations of the People’s Republic of China on Traditional Chinese Medicine

Article 26 A non-profit institution of traditional Chinese medicine enjoys preferential policies such as financial subsidy and tax reduction and exemption in accordance with the relevant provisions of the State.

Article 27 Medical institutions designated for the basic medical insurance of urban staff and workers by the labor and social security administrative department of the local people’s government at or above the county level shall include qualified institutions of traditional Chinese medicine. Designated institutions of traditional Chinese medicine shall provide basic medical service to the individuals with insurance in accordance with provisions.

Article 28 The people’s government at or above the county level shall take measures to strengthen collection, collation, study and protection of the literature of traditional Chinese medicine. The relevant units and institutions of traditional Chinese medicine shall strengthen management, protection and use of the important literature of traditional Chinese medicine.

Article 29 The State protects wild resources of traditional Chinese medicinal substances, and supports the research, development and use of artificial substitutes for endangered species of plants and animals used as traditional Chinese medicinal substances. The local people’s government at or above the county level shall make efforts to rationally develop and exploit traditional Chinese medicinal substances, encourage the establishment of bases for their plantation or breeding, and promote the development and production of traditional Chinese medicinal substances in short supply.

Article 30 In an evaluation or appraisal of traditional Chinese medicine, the characteristics of traditional Chinese medicine shall be reflected and its law of development be observed. A special evaluation or appraisal committee of traditional Chinese medicine shall be organized, or experts of traditional Chinese medicine shall be invited, to conduct the evaluation of professional qualification for professional titles, the evaluation and assessment of medical, educational and research institutions, or the appraisal of applications for scientific research projects and the research results thereof in the field of traditional Chinese medicine.

Chapter V Legal Liability

Article 31 Where, in violation of the provisions of these Regulations, a staff member of the department responsible for administration of traditional Chinese medicine, in administration of traditional Chinese medicine, accepts money, property, or other benefits by taking advantage of his position, abuses his power, neglects his duty, or fails to investigate and deal with the illegal activities discovered, which causes serious consequences and thus constitutes a crime, he shall be investigated for criminal liability according to law; if his act is not serious enough for criminal punishment, he shall be given an administrative sanction of demotion or dismissal from his official post.
