Article 37 Where an institution of traditional Chinese medicine alters the content of its approved therapeutic advertisement of traditional Chinese medicine, the original examining and approving department shall cancel the approval number of the advertisement and shall not accept within one year applications from the institution of traditional Chinese medicine for examination and approval of advertisement. After canceling the approval number of the therapeutic advertisement of traditional Chinese medicine, the department responsible for administration of traditional Chinese medicine shall notify the supervisory and administrative organ for advertisements within five workdays from the date of making the administrative decision. The supervisory and administrative organ for advertisements shall investigate and deal with the case in accordance with the relevant provisions of the Advertisement Law of the People’s Republic of China within 15 workdays from the date of receiving the notification from the department responsible for administration of traditional Chinese medicine.
Chapter VI Supplementary Provisions
Article 38 As used in these Regulations, an institution of traditional Chinese medicine refers to a hospital, out-patient department or clinic of traditional Chinese medicine or of integrated traditional Chinese medicine and Western medicine, which has obtained a license for the medical institution according to law.
The administration of ethnic medicine shall be conducted with reference to these Regulations.
Article 39 These Regulations shall be effective as of October 1, 2003.
