II. Requirements
1. Foreign investors should be able to independently bear civil liabilities, have experience in medical and health investment and management, and meet one of the following requirements:
a. Capable of offering advanced hospital management ideas, and management and service models
b. Capable of offering advanced medical technology and equipment
c. Capable of improving local medical service, technology, fund and facilities
2. The wholly foreign-owned hospitals should meet basic national medical institute standards. If not, please refer to the notice on specialized hospital establishment approval and management regulations by the Ministry of Health (No 87, 2011).
3. Foreign investors should file applications to municipal health and family planning administrations (including local traditional Chinese medicine departments) for preliminary approval, which will then be submitted to provincial health and family planning administrations. Then, provincial business departments will give a final review on the establishment of wholly foreign-owned hospitals in accordance with foreign investment laws and regulations.
4. Establishment of wholly foreign-owned hospitals and related changes should go through standard legal procedures in line with the Regulations on Administration of Medical Institutions, the Detailed Rules for the Implementation of the Medical Institute Management Regulations, and the foreign investment management methods.
5. Establishment of wholly foreign-owned hospitals should also meet requirements made by provincial (municipal) health and family planning administration and business departments.
III. Implementation
1. Provincial health and family planning administration and business departments should take steps to open up the medical institute market and control risks in formulating a plan to build wholly foreign-owned hospitals. They should also review, supervise and manage wholly foreign-owned hospitals in accordance with the law. The plan should be submitted to the National Health and Family Planning Commission and the Ministry of Commerce before implementation.
2. Wholly foreign-owned hospitals should abide by relevant national laws, regulations and rules, including routine clinical diagnosis and treatment, technical specification, and medical technology admittance to strengthen medical quality management and guarantee medical safety.
3. The provincial (municipal) health and family planning administration should supervise and manage wholly foreign-owned hospitals in accordance with the law and submit their registration information.
